“We,” “us”, “our” mean BFS Group Limited (t/a Bidvest Catering Equipment), a company registered in England and Wales, company number 239718, whose registered office is at Buckingham Court, Kingsmead Business Park, High Wycombe, Bucks HP11 1JU.
“You,” “Your” means our customer placing the order with us.
OPENING YOUR ACCOUNT
1. Your account:
Before you can place any orders with us, you will need to have a trading account with us. If you do not have an account, to register for your trading account please call your local depot - for details visit our website www.bidvestcateringequipment.com
The contract between you and us will be made only when we accept your order. The contract is intended to benefit you and us only and will be on these terms alone.
We may change these trading terms at any time. Any such changes will take effect when notified to you (whether in our next pricelist, on our website www.bidvestcateringequipment.com or otherwise) but will not affect any of your orders that we have accepted before such notification. It is your responsibility to check for the up to date trading terms.
Prices are fixed on the day of delivery, not when your order is accepted. VAT will be charged at the applicable rate. We try to ensure that all advertised pricing is accurate. Errors, however, may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of re-confirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
The pricing on our website www.bidvestcateringequipment.com may vary from our priced catalogues, some offers are only available for online users. Web offers cannot be used in conjunction with National price agreements.
Online offers are only available for Bidvest Freetrade account customers and non-government funded bodies
PLACING YOUR ORDER
Orders are accepted subject to availability of the product from the manufacturer/importer.
to take advantage of any promotion, your delivery date must be between the advertised effective dates of the promotion.
Web exclusive promotions (identifiable by online motif) must be dealt with as a pre payment by credit card and are not to be used in conjunction with any existing account payment terms
8. Minimum Delivery:
Your order should be for at least £40 (ex-VAT). If you order less than £40 we may make an additional delivery charge and we would notify you of this when you place your order.
9. Splitting Charges:
If you wish we are able to split many original cases. In some instances a minimum split quantity may apply and we may make an additional charge for split cases.
10. Last Orders:
Orders must be received before 2.00 p.m. on the day prior to delivery.
DELIVERING YOUR ORDER
Delivery will be to the address that you give to us when you register for your trading account. We will make the delivery only to an adult (18 years of age or over) The delivery date and time which we arrange with you, are approximate only and other than as is set out at 18 below, we will not be liable for any cancelled or delayed delivery. You must ensure that there is an adult at the delivery address to sign for the delivery during the agreed date and time.
All risks in the goods will pass to you on delivery. Ownership of the goods delivered will remain with us until our receipt of full payment from you of all sums outstanding to us.
Please check your delivery with our driver as you must inform us of shortages at the time of delivery and of damage within 24 hours of delivery.
Undamaged goods may not be returned without our prior agreement and must be accompanied by a copy of the signed delivery note. For these returns you must make your claim for credit within 28 working days of delivery. We do not give credit for any product received by us soiled, broken or damaged by insufficient packing for its return to us. No credit will be given on any goods which are a non-listed and obtained specifically to fulfil your requirements. If we retrieve the goods from you, we may charge for this. We do not refund any delivery charges incurred on such returns.
Your account must be settled by the 16th of the month following invoice date and sent to the statement address. If your account is in arrears, we may withhold further supplies.
16. Credit Claims:
if you dispute our invoice you must inform us promptly and, in any event, within 90 days of receipt of our invoice.
All goods offered for sale are warranted to be of the nature, substance and quality described and to comply with all statutory requirements from time to time in force relating to the sale of such goods.
Product description All dimensions and descriptions are correct at the time of publication, but due to manufacturers’ changes should be used as a guide only. Photographs or pictures of products are for illustration and may not reflect in every detail the product on offer.
We accept unlimited liability for personal injury or death arising from our negligence and for all other matters for which it is unlawful for us to limit our liability under English law. We will not be liable to you whether in contract, tort (including negligence) or breach of statutory duty for any: (a) loss of profit, loss of business or business opportunity, loss of contract, loss of goodwill, management time; or (b) any special, indirect or consequential loss. Other than this, our liability arising out of any order by you for the supply of goods to you will be limited to the price of the goods in that order.
We do not accept liability for any failure to perform or delay in performance caused by events outside of our reasonable control (such as strikes, trade disputes, accident, breakdowns, shortages affecting us or our usual sources of supply or our means of delivery of the goods).
Copyright and all other intellectual property rights in the products shown in our lists (including in any images or product data) shall remain at all times our property and you will not acquire any rights in the products except as is expressly provided in these trading terms.
The contract and any claims arising in connection with it shall be governed by English law and any dispute between us will be resolved in the English courts.
Bidvest Catering Equipment does not sell knives or similar products to persons under 18 or by retail sale. Therefore if you are under 18 years or are a retail customer (ie, not a trader wishing to purchase in the course of your business), please do not proceed further with attempting to purchase any knife or similar product.
